Agreement to these terms
Recursioncards.com is run by Recursion Cards LLC, a South Carolina limited liability company. "We", "us" and "our" mean that company. "You" means anyone using the site.
Using the site means you agree to these terms. That includes browsing, searching, creating an account and filing a support request. If you do not agree with them, do not use the site.
These terms cover this website. Every card on this site is our own stock, kept by us and packed by us.
Who may use the site
You must be 18 or older to have an account. Between 13 and 18, you may use the site only with a parent or guardian who accepts these terms and takes responsibility for what you do here. The site is not for anyone under 13.
We sell and ship within the United States.
You confirm that the information you give us is accurate, and that nothing in the law where you live stops you buying what we sell.
Your account
An account is free. Browsing and searching need no account.
You are responsible for keeping your password confidential and for everything that happens under your account. Our sign-in, registration and password-reset forms use Google reCAPTCHA, which is subject to Google's own terms and privacy policy.
We can suspend or close an account used to break these terms, to abuse the site, or to defraud us or another shopper. You can close your own account from your account settings. The Privacy Policy says what happens to your information when you do.
Your privacy
What we collect, what we do with it, and the choices you have are in the Privacy Policy, which forms part of these terms.
What we sell
We sell single cards and sealed product for Magic: The Gathering, Pokémon, Star Wars: Unlimited, Dragon Ball Super: Fusion World, Dragon Ball Super: Masters, Riftbound and Flesh & Blood.
- Condition. Singles are graded Near Mint, Lightly Played, Moderately Played, Heavily Played or Damaged. Grading is a judgement made by eye, and a card between two grades gets the lower one.
- Printing. Where a card exists in more than one printing (Foil, Holofoil, Reverse Holofoil, 1st Edition), the card page names it. Two printings of one card can be worth very different amounts.
- Photographs. The picture on a card page is a stock image of that card and printing, not a photograph of the copy we will send you. The condition we state is what describes your copy.
- Sealed product is sold sealed. We do not open it and we cannot tell you what is inside it. Pull rates are set by the publisher.
- Market prices shown on this site come from third-party data. They describe a market. They are not an appraisal of your card and not investment advice.
We describe what we sell as carefully as we can, and we do not warrant that every description is free of error. A card we described wrongly is our mistake to fix.
Selling cards to us
We buy singles, sealed product and whole collections. Tell us what you have through the selling form and we will respond with an offer.
Any figure we give before we have seen the cards is an estimate, not an offer, and nothing binds either of us until we have both agreed it in writing. You are free to decline an offer. When you send us cards you confirm that they are yours to sell and that they are genuine.
Acceptable use
Do not:
- Attack, probe or overload the site, or work around rate limiting, bot protection or authentication.
- Scrape or bulk-download the catalog, or point automated tools at the site.
- Use another person's account, or misrepresent who you are.
- Send us anything unlawful, malicious or infringing.
- Use the site to defraud us, another shopper, or a site we sell on.
- Pass off our data or our images as your own.
We can suspend access for any of this, and we report serious cases.
Intellectual property
Our content
The site itself belongs to us: its design, text, layout, logos, our own photography, and the arrangement of the catalog. Do not copy, republish or resell it without our permission. Linking to the site is permitted.
Automated bulk collection of the catalog is not permitted. If you want our data, ask us.
Cards, games and trademarks
Card names, card images, set names, symbols and game trademarks belong to their publishers and licensors, not to us. That includes Wizards of the Coast (Magic: The Gathering), The Pokémon Company (Pokémon), Bandai (Dragon Ball Super: Fusion World and Dragon Ball Super: Masters), Legend Story Studios (Flesh & Blood), Fantasy Flight Games (Star Wars: Unlimited) and Riot Games (Riftbound), among others.
We use those names to identify the products we sell. Recursion Cards is an independent retailer. We are not endorsed by, sponsored by, or affiliated with any of these companies.
Copyright complaints
Tell us through the support form. Say what the work is, where on the site you found it, and how we can reach you. We will take the material down or explain why we have not.
Anything you send us
If you send us content, you keep ownership of it. That covers a support message, a photo of a card, and feedback about the site. You give us permission to use it for the purpose you sent it for: answering you, resolving an order, or improving the site. If you send us a suggestion, we may act on it without owing you anything for it. Do not send us anything you do not have the right to send.
The site does not host public reviews, comments or posts. If we add anything of that kind, we will update these terms first.
Emails we send you
Some email comes whether or not you are on any list: account and password mail, and mail about your support requests.
Marketing email is separate. You only get it if you asked for it and confirmed the address. Every message carries an unsubscribe link, and unsubscribing stops the marketing without touching the mail above.
Other companies and links
The site runs on services operated by other companies: hosting, authentication, bot protection, email delivery and catalog data. What those companies do with what they receive is governed by their own terms and privacy policies, and the Privacy Policy names them.
Links to other websites are there for convenience. We do not control them and we are not responsible for them.
eBay orders
We sell on eBay, and an eBay order is not an order on this site. That order, its payment, its shipping, its returns and any dispute are governed by eBay's user agreement and policies, together with the terms of the listing you bought from. eBay's Money Back Guarantee covers those orders. If an eBay order goes wrong, start with eBay messages.
We are a seller on eBay and are not otherwise affiliated with it. Where this site and an eBay listing disagree about a card, the eBay listing governs that order.
Disclaimer of warranties
The site is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the site will be uninterrupted or error-free, or that the catalog, our prices, market prices or availability shown here are complete or current at any given moment.
Nothing here removes a right you have under law that cannot be waived, including consumer rights and any warranty stated in an eBay listing.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost opportunity, arising out of or connected with your use of the site.
Our total liability for any claim relating to the site or an order is limited to the amount you paid us for the order the claim relates to.
Some states do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the two sections above apply only as far as that state permits.
Indemnity
If a claim is brought against us because of how you used the site, you agree to cover the reasonable costs and losses we incur from it, including legal fees. That covers breaking these terms, breaking the law, and infringing someone else's rights. We will tell you about any such claim promptly and let you take part in the defense.
Governing law and disputes
These terms, and any dispute arising out of them or out of your use of the site, are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules.
If we have a dispute, tell us first.
If that does not resolve it, the dispute will be brought in the state or federal courts serving Kershaw County, South Carolina, and we each consent to the personal jurisdiction of those courts and to that venue.
These terms contain no arbitration clause and no class-action waiver. You keep the right to bring a claim in court.
Nothing above takes away a right you have under the consumer-protection law of the state you live in, including the right to bring a qualifying claim in your own state's small-claims court.
A dispute about an order placed on eBay goes through eBay's own dispute process first.
Severability, waiver, and the whole agreement
If a court finds part of these terms unenforceable, the rest still stands, and the affected part is narrowed to what can be enforced. If we do not enforce something immediately, we have not given up the right to enforce it later.
You may not transfer your rights under these terms. We may transfer ours if the business changes hands.
These terms and the Privacy Policy are the entire agreement between you and us about this site. An order placed on eBay is additionally governed by eBay's terms and by the listing.
Changes to these terms
We update these terms as the business changes. When we do, the "Last updated" date at the top of this page changes with them. If a change materially affects your rights, we will email everyone who has an account. Continuing to use the site after a change means you accept it.
